PRIVACY STATEMENT

This Privacy Statement describes the types of information Vi Inc. (“Vi”, “we”, “our” or “us”) collects from and about you when you visit our websites, such as www.vitrainer.com (each a “Site”), use our mobile applications (each an “App”), or use our devices (each a “Device”).  Our Sites, Apps, and Devices may be designed to work together, and they are collectively the “Services.” This Privacy Statement also explains how Vi may use and disclose such information, as well as your ability to control certain uses of it.

By using the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Statement.  If you do not, please do not use the Services.  

HOW WE COLLECT YOUR INFORMATION

Vi collects personal and personally identifiable information from you when you choose to share it with us.  This may include when you use our Services, create an online account with us, make a purchase, request information from us, sign up for newsletters or our email list, participate in a survey or promotion, or otherwise contact us.  The personal information we collect may include your name, address, email address, telephone number, photo, geolocation, biometric information such as heart rate data, audio and voice recording, username, date of birth and, if you make a purchase from us, a credit/debit card number or other financial information.  

On Our Site and App. We may use cookies, log files, or other similar technologies (collectively, "cookies") to collect certain information about visitors to our Site and App and interactions with our emails and online or mobile advertisements, and to allow Vi to keep track of analytics and certain statistical information which enables Vi to improve its Services and provide you with more relevant content and advertising on our Services and other sites.  

For example, we may automatically collect certain information from you, including but not limited to your health and performance information, browser type, device type, operating system, unique device identifier of any of your computer(s) or device(s) that are used to access the Services, software version, Internet Protocol (“IP”) address, phone model, phone operating system, and the domain name from which you accessed the Services.  Data collected by the Device may be stored on the Services (including such as your health and performance information).  We also may collect other information about your use of the Services, including the route and location of your workouts, performance data, date and time you visit the Services, the areas or pages of the Services that you visit, the amount of time you spend viewing or using the Services, the number of times you return to the Services, other click-stream or Site / App usage data, emails that you open, forward or click-through to our Services, websites you visit prior to or after you arrive on our Site and other sites that you may visit.  Additional information about the cookies used on the Services is available below.

Workout Performance Data Collected Through our Device.  We may collect your performance information when you use the Device.  This may include your workout data, calories burned, distances ranrun, step rate, cadence, speed, and heartrate.  You have the ability to control whether this information is collected through the settings in the App or on your mobile phone.  We may also collect the Device serial number, MAC address or other unique identifiers when you pair the Device with the App.

From Social Media and Other Sources.  We obtain information about you from social networks and other apps or services if you use them to connect, or create an account, with us.  This information includes:

If we receive your contact details from these third party sources, we may use them to send you information about our products and services. You will always have the opportunity to opt out of, or unsubscribe from, receiving these communications.

We may combine the information we receive from and about you, including information you provide to us and information we automatically collect through our Site, App and Device, and from third party sources, such as social media accounts and music services, in order to enhance the Services.  .

TRACKING OPTIONS AND CALIFORNIA DO NOT TRACK DISCLOSURES

Browser and System Controls. Certain parts of our Services require cookies. You may set your browser or operating system to limit certain tracking or to decline cookies, but you may not be able to use certain features on the Services. For example, if cookies are disabled you will not be able to log into the Site.  Each browser and operating system is a little different, so please check your browser or operating system’s settings or help section to learn more about how to delete or disable cookies and tracking.  We do offer the ability to opt out of our tracking services, but please note product functionality will be limited and you may not be able to use the Services.

Do Not Track and Interest-Based Advertising. Our system may not respond to Do Not Track requests or headers from some or all browsers. We may use cookies or other technologies to deliver more relevant advertising and to link data collected across other computers or devices that you may use. Here are options to understand your choices for receiving more relevant advertising or to manage your settings:

Third Party Service Providers. We may use third party service providers to support our Services.  Some of these service providers may use technology such as cookies and log files to collect and manage information on our behalf.

Third Party Analytics and Tracking Technologies. We may use third parties’ analytics and tracking tools to better understand who is using the Services, how people are using the Services, how to improve the effectiveness of the Services and related content, and to help us or those third parties serve more targeted advertising to you across the Internet. They may also combine information they collect from your interaction with the Services with information they collect from other sources. We do not have access to, or control over, these third parties’ use of cookies or other tracking technologies. You can opt out of these tracking tools in your App settings.

We are not responsible for notices that are not labeled or sent properly, or do not have complete information.  

ACCESS TO YOUR INFORMATION

You may access, update, and delete certain information by adjusting your profile and settings in the Services.

INDIVIDUALS' RIGHTS IN THE EUROPEAN UNION

In addition to the above methods, if you are accessing the Services from the European Union, you may wish to view, delete, restrict, correct or receive a copy of the personal information collected about you in a structured, machine readable format. Where we process your information with your consent, you may withdraw it at any time.
